§1 Validity towards entrepreneurs and definition of terms
(1) The following General Terms and Conditions of Business apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes which can predominantly be attributed neither to his commercial nor his independent professional activity (§ 13 BGB).
§2 Conclusion of a contract, storage of the contract text

(3) The presentation of the goods in our Internet shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
The offer is accepted in writing or in text form or by sending the ordered goods within one week. If this period expires without result, the offer shall be deemed to have been rejected.
(4) The following regulations apply when an order is received in our online shop: The consumer submits a binding contractual offer by successfully completing the order procedure provided in our Internet shop.
The order is placed in the following steps:
1) Selection of the desired goods
2) Confirm by clicking on the ‘Order’ button
3) Check the details in the shopping basket
4) Login to the Internet shop after registering and entering the login details (e-mail address and password).
5) Re-check or correct the data entered.
6) Binding dispatch of the order by clicking on the button ‘order for a fee’ or ‘buy’
Before submitting the binding order, the consumer can return to the website on which the customer’s details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the ‘Back’ button contained in the Internet browser used by him after checking his details. We confirm receipt of the order immediately by sending an automatically generated e-mail (confirmation of receipt). This does not constitute acceptance of the offer. The offer is accepted in writing, in text form or by sending the ordered goods within one week.
(5) Storage of the contract text for orders via our Internet shop: We store the contract text and send you the order data and our General Terms and Conditions by e-mail. You can also view the GTC at any time at https://provoke-festival.de/agb/. You can view your past orders in our customer area under My account –> My orders.
§3 Prices, shipping costs, payment, due date
(1) The prices quoted include statutory VAT and other price components. Any shipping costs are added.
(2) The consumer has the option of paying in advance, PayPal, credit card (Visa, Mastercard).
(3) If the consumer has chosen payment in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.
§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for dispatch immediately. Delivery will be made within 2 working days at the latest. In the case of payment in advance, the delivery period begins on the day after the payment order is sent to the bank responsible for the transfer and for all other payment methods on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline shall end on the next working day.
(2) The risk of accidental loss and accidental deterioration of the item sold shall not pass to the buyer until the item is handed over to the buyer, even in the case of sale by despatch.
§5 Retention of title
We reserve title to the goods until the purchase price has been paid in full.
§6 Right of cancellation of the customer as a consumer
There is no right of cancellation for consumers or the right of cancellation for consumers may expire prematurely for the following contracts:
Contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transport of goods, motor vehicle hire, delivery of food and beverages and for the provision of other services in connection with leisure activities, if the contract provides for a specific date or period for the provision (Section 312g (2) sentence 1 no. 9 BGB). This means that if XTR COLOGNE UNUSUAL MEDIA GmbH offers services in the area of leisure activities, in particular tickets for events, there is no right of cancellation. Every order for tickets is therefore binding immediately after confirmation by XTR COLOGNE UNUSUAL MEDIA GmbH in accordance with Clause III. 1. and obliges the customer to accept and pay for the tickets ordered.
§8 Warranty
The statutory warranty regulations apply.
§9 Contract language
The contract language is exclusively English.
§10 Creatorday 2025 cashback clause
For some tickets that can be purchased via this website for Creatorday 2025, there is a cashback clause. This includes obligations of the buyer regarding the promotion of the event on social media, whereby the buyer and the organiser enter into a mutual contractual relationship. The Event Organiser will call for six coordinated social media promotions on the website and by email and will provide instructions on the design of the promotions (format, media, links, hashtags and timing). The organiser is entitled to refuse payment if the necessary requirements are not met. This includes, but is not limited to:
Proof of entitlement to cashback is the responsibility of the customer in the event of a dispute.
